Suffering an injury in a car crash presents many physical, emotional, and financial challenges for a person to overcome. When such a disruption in your life occurs due to another’s reckless actions that could have been prevented, it’s important to stay positive and access as much information as possible about your legal rights and options.
Distracted driving is a form of driver negligence that puts everyone on the roadway in great danger. It is inexcusable, and, unfortunately, widespread. One of the most common and dangerous forms of distracted driving involves cell phone use.
At Reiff & Bily, our Philadelphia car accident attorneys help victims of distracted drivers pursue fair compensation for their losses. We fight to protect the rights of our clients while holding the at-fault parties accountable. Our law firm was named as one of Philadelphia’s Top Rated Personal Injury Law Firms and Jeffrey M. Reiff was included in the 2012 list of Philadelphia’s Top Rated Lawyers. To obtain more information about pursuing your legal rights, please call us at (215) 274-0072 for a free, no obligation consultation.
Pennsylvania’s Cell Phone Laws
Prior to March 2012, Philadelphia law enforcement officers had the ability to pull over drivers for using their cell phone while driving without a headset or Bluetooth. That changed on March 8, 2012 when Pennsylvania’s new no-texting-while-driving law went into effect. This statewide ban supersedes Philadelphia’s cell phone laws. Under the new law, drivers are not allowed to text while driving, but they can legally make a phone call while behind the wheel.
Under current law, there is a primary ban on texting while driving for all motorists. When there is a primary ban, officers can pull over drivers who are sending a text even they are not violating any other traffic laws.
Making Your One Shot at Justice Count
While filing a personal injury claim or pursuing a lawsuit is a big decision, according to 42 Pa. Cons. Stat. Ann. § 5501 et seq., a person only has two years to do so. It’s important to make the choice that’s right for you, and you may not even have a case; however, time is of the essence and you must act quickly, but intentionally.
Having a lawyer assist you with your case can be beneficial mainly because your attorney has been down this road before. You want legal help from a professional who has extensive resources and effective strategies, but who is also prepared to handle the unexpected.
